If you are redoing your brochures for 2014, please send us some as they become available. We want to ensure that we can adequately display all of our member campgrounds to the consumers at all of our shows. October 1st Deadline for ACA Compliance
MARVAC Insurance Update!
By Mark Barrett, CIC
Bloomfield Hills Insurance Agency & Insurance agent of record for MMH & RVCA
More paper work – just because you did not have enough! It’s time to start work on the Affordable Health Care Act. And yes this includes those who have under 50 employees. In order to be in compliance with Fair Labor Standard the federal government requires all employees be given a notice from their employer. To be safe this should include all 1099 independent contractors.
MMHA thanks HBA (Home Builders Association of Southeastern Michigan) CEO Michael C. Stoskopf for permission to publish the following article.
HEADS UP: MOST EMPLOYERS MUST SEND AN INSURANCE NOTICE TO EMPLOYEES BEFORE 10/1/2013, EVEN IF YOU HAVE FEWER THAN 50 EMPLOYEES
By Michael Stoskepf
Like many people, I was under the impression that the Affordable Care Act (PPACA or Obamacare) would only impact companies with 50 or more employees. I recently learned that while the 50 employee threshold refers to the requirement to provide insurance, it does not apply to the notice requirements that are associated with the law. Even employers like HBA, with only 6 employees, are required to send a notice about healthcare options to each employee by October 1. This is true whether you offer healthcare to your employees or not, as long as your company is required to be compliant with the Fair Labor Standards Act (FSLA).
I strongly encourage you to seek professional guidance, perhaps from your insurance agent, third party administrator, accountant or attorney, to determine what action is needed to keep your company in compliance with the law. Being proactive may keep you from facing legal problems down the road.
Here are some easy links to help you:
- DOL Technical Notice published in May 2013 indicates that employers who are required to be Fair Labor Standards Act (FSLA) compliant must fulfill the notification required by PPACA. The Federal government provides the following link for FLSA Determination:http://www.dol.gov/elaws/esa/flsa/scope/screen24.asp.
- If you determine that you must provide notification in accordance with PPACA, the Department of Labor has provided “model forms” that can be used by employers, depending on whether or not you offer/or plan to offer healthcare insurance as of January 1, 2014:
- Link to Model Form for Employers OFFERING healthcare:http://www.dol.gov/ebsa/pdf/FLSAwithplans.pdf
- Link to Model Form for Employers NOT OFFERINGhealthcare: http://www.dol.gov/ebsa/pdf/FLSAwithoutplans.pdf
Special Invitation for MARVAC Members
Your Association is proud to announce a historic initiative regarding the issue of financing in our Industry. MMH & RVCA in partnership with Alternative Investment Resources, will unveil this landmark program in a special member only session. There is no doubt that over the last three years our MARVAC membership has experienced difficulties in securing financing for their dealerships and campgrounds. Michigan’s economic woes have had a serious effect on all small Michigan businesses. The number one call received at the Association office from our members is regarding a lack of available financing to our businesses and customers.
As a result of these phone calls, your Association’s Board of Directors has been seeking an alternative so that those members that can qualify, will have access to additional financing opportunities. All MARVAC members will be invited to a special presentation to learn more about this new financial preview. The meeting is scheduled for Tuesday, October 29th, 2013 at theSuburban Collection Showplace in Novi, MIchigan in conjunction with the MMHA Conference, starting at 8:00 A.M.
Due to the exclusivity and confidential nature of this announcement, ALL members attending this session will be required to sign a Mutual Non-Disclosure and Non-Circumvention Agreement in order to see how this program will benefit their business in the future, as a new membership benefit.
Also on the program that morning we have invited Special Guest, U.S. Senate Candidate Terri Lynn Land (R) to address the membership. She will provide an overview on the direction of her campaign and discuss what she will do when elected in November of 2014. As you may, or may not know, Terri is a former member of the Association and was an Association employee for a year and a half prior to starting her political career, where she served two terms as Michigan’s Secretary of State.
You will be receiving an invitation and registration form to participate in this FREE event. This information will soon be available on our website, marvac.org. We strongly encourage you to hold the date ofOctober 29th, and plan on joining us and your fellow MARVAC members for this historic session.
